Description of module content:

Private law is the part of the legal system dealing with disputes between individuals. This module deals the issues facing Scots private law in the 21st century. We will cover three broad areas within private law: the law of contract (the law governing the formulation of enforceable agreements); delict (the law governing civil wrongs); and succession (the law governing the distribution and management of wealth after death).

All of these areas are encountered regularly in legal practice. Their ubiquity renders them enormously important. Consequently, we will develop an in-depth knowledge of them by examining the key issues currently affecting them, developments in case law, legislative and policy approaches, and the cases for and against reform,

Since Scotland is a mixed legal system, particular weight will be given to the comparative approach and to the international context. There will be frequent reference to Anglo-American law and the law of other legal systems.

Learning Outcomes for module:

LO1: Develop an in-depth knowledge and understanding of Scots Private Law.
LO2: Critically analyse and evaluate law, policy and legal issues relating to the Scots law of contract, delictual liability and the law of succession.
LO3: Critically evaluate the current provisions of the law and proposals for reform in the areas explored.
LO4: Undertake independent research with minimal supervision, starting from standard legal information sources.
LO5: Demonstrate competence in the construction and support of a written legal argument.
