Description of module content:

This Module addresses : Contract documents, Types of contracts, applications and principal features: Standard Forms of Contract - availability and applications; relationship to common and statute law and ordinary contracts, Provisions of current JCT SBC in regard to: Obligations of the Parties; Instructions; Variations; Completion; Practical Completion and Making Good Defects; Payments, Retention and Final Accounts; Insurances and bonds; Damages; Contractual Claims; collateral warranties; Subcontracting; Determination, NEC contract conditions and how they differ from the JCT SBC conditions, Relevant Case Law.

Learning Outcomes for module:

Upon completion of this module you will be able to

LO1: Explain the contractual documentation and various types of construction contracts, identifying their principal features and suitability for different project types.

LO2: Prepare and assess payment valuations, contractual claims, and variations as per the key provisions within the JCT SBC.

LO3: Identify and evaluate legal remedies , including damages, collateral warranties, and subcontracting within the context of JCT SBC, NEC, and relevant case law.

LO4: Interpret and explain key provisions within the JCT SBC, including obligations of the parties, Making Good Defects, insurance, bonds, and other contractual requirements.

LO5: Compare NEC contract conditions with JCT SBC with emphasis on their provisions and applications, assessing differences in structure, risk management and selecting appropriate contract types for project scenarios.

Face To Face Tutorial 10 Over these 10-hours of tutorials, the students will be learning to apply theoretical knowledge to practical problems, covering key areas such as contract documents, types of contracts, and the applications of standard forms of contract JCT and NEC, payment, time-related, quality-related clauses and legal remedies through activities like case studies.
Online Guided independent study 170 Students will use this time to review what they’ve learnt from lectures to deepen their understanding of course materials, conduct thorough research, critically analyse relevant case studies, and apply theoretical concepts to practical scenarios.
