Description of module content:

Environmental law is a body of international, regional and domestic regulations seeking to address an ever-growing set of environmental issues and challenges which ignore jurisdictions and borders. Because environmental problems have a transnational dimension and impact, it follows that international law significantly contributed to the development of this area of the law. Therefore the module will first explore the sources of environmental law with specific emphasis given to the main principles of international environmental law and how they have in turn influenced UK and/or Scottish law be it at the statutory level with the Environment Act of 2021 and through the common law. The module will then shift its emphasis on the four main priority areas provided for under the Environment Act of 2021 namely: air quality and climate change, water, the biodiversity crisis, resources efficiency and waste reduction and will further broaden the scope of the study to ocean pollution and environmental justice. All the aforementioned issues will be examined under both an international and domestic perspectives.

Learning Outcomes for module:

Upon completion of this module you will be able to

LO1: Critically understand key global environmental issues and the relevant legal frameworks in force to address them both at the international, regional and domestic level.

LO2: Understand the interrelationship between international, regional and municipal environmental law especially with regard to legal mechanisms for monitoring and compliance.

LO3: Critically apply the knowledge gained to case studies on these key issues making use of the relevant and applicable legal frameworks.

LO4: Appreciate the bridges and connections with other legal disciplines and beyond as environmental law increasingly permeates all legal fields and other disciplines.
