Description of module content:

Children and their rights are an interesting and developing legal topic, particularly given the Scottish Government?s commitment to implementing the United Nations Convention on the Rights of the Child. In this module, we consider key aspects of theory, law and practice to better understand the area, drawing on Scottish, UK and international sources. Indicative Seminar topics: i) What is ‘childhood??; ii) Children?s rights: philosophy; iii) Children?s rights: positive law, including the UNCRC & ECHR; iv) Self-determination; v) The welfare principle; vi) Participation rights in Scotland; vii) the Children and Young People?s Commissioner Scotland

Learning Outcomes for module:

Upon completion of this module you will be able to

LO1: Critically analyse key issues arising in respect of Children's Rights-based law, theory and practice.

LO2: Evaluate the provisions made in Scottish Law, and in comparable jurisdictions, in respect of incorporation and implementation of the United Nations Convention on the Rights of the Child.

LO3: Analyse and evaluate legal and legal policy decisions made in respect of existing and emerging areas of Children's Rights' Law.

LO4: Sustain oral and written discourse to appropriate level.
