Description of module content:

Children and their rights are an interesting and developing legal topic, particularly given the Scottish Government’s commitment to implementing the United Nations Convention on the Rights of the Child. In this module, we consider key aspects of theory, law and practice to better understand the area, drawing on Scottish, UK and international sources.
Indicative Seminar topics: i) What is ‘childhood’?; ii) Children’s rights: philosophy; iii) Children’s rights: positive law, including the UNCRC & ECHR; iv) Self-determination; v) The welfare principle; vi) Participation rights in Scotland; vii) the Children and Young People’s Commissioner Scotland

Learning Outcomes for module:

LO1: Critically discuss the concepts of childhood and children’s rights, and their significance for law
LO2: Analyse key issues arising in respect of Children's Rights law, policy and practice.
LO3: Evaluate the provisions made in Scottish Law, including the incorporation and implementation of the United Nations Convention on the Rights of the Child.
LO4: Sustain written discourse to appropriate level.
