Description of module content:

Children and their rights are an interesting and developing legal topic, particularly given the Scottish Government’s commitment to making the United Nations Convention on the Rights of the Child an effective law. In this module, we consider key aspects of theory, law and practice to understand the area better, drawing on Scottish, UK and international sources. The seminars cover the topics of childhood, children’s rights philosophy, children’s rights positive law, self-determination, the welfare principle, the participation rights in Scotland and beyond, the group debate about one particular issue within the children’s rights law, the children protection during the armed conflicts.

Learning Outcomes for module:

Upon completion of this module you will be able to

LO1: Critically analyse key issues arising in respect of Children's Rights-based law, theory and practice.

LO2: Evaluate the provisions made in Scottish Law, and in comparable jurisdictions, in respect of incorporation and implementation of the United Nations Convention on the Rights of the Child.

LO3: Analyse and evaluate legal policy decisions made in respect of existing and emerging areas of Children's Rights' Law.

LO4: Comprehend and assess the international humanitarian law protecting the children during the armed conflicts

LO5: Sustain oral and written discourse to appropriate level.
